These are risks we would not accept in the judicial system under any circumstances, let alone one that can't be undone. A Judge in Iowa has no means to become skilled at presiding over a case like this until the case is underway. Sometimes that means prosecuting a person until conviction sometimes that means dropping a case and moving on. These lawyers are required to seek justice as define it under our constitution and laws. While defense attorneys' role is simply limited to forcing the government to prove every element of a crime, a County Attorney / prosecutor has a more complex role. Please note, I do not mean just defense attorneys. There will be no *skilled* death penalty lawyers for years.

There will be no death penalty qualified lawyers if and when the first trial under this proposal occurs. Second, as a practical matter, there are literally no death penalty qualified lawyers in the state of Iowa. Under our current system, that accounts for mistakes, even when they are enormous, they can be undone. The chance of that happening is so remote as to be nonexistent. This means a prosecutor can't make an error of fact or judgment neither can a judge neither can a state public defender. SSB 1004, if enacted, would require that every level of government is always without error. As you may know, our mission is to ensure that governments always act in a way that protects people's legal rights and liberties. Senators Garrett, Bisignano, & Schultz The ACLU of Iowa respectfully opposes SSB 1104, and asks this bill not proceed.
